Terms of Service
These terms apply to the Sailvane website (sailvane.com) and to the Sailvane software. Sailvane is in development and is not yet available to the public. Anyone given early access will use it on these terms.
1. About us
Sailvane is an independently developed software product, operated by Elliott Thornhill, an individual based in the United Kingdom ("Sailvane", "we", "us"). Sailvane is not a registered company. Contact: support@sailvane.com.
2. Who can use Sailvane
Sailvane is for businesses and marketing agencies, not consumers. By using it, you confirm you are at least 18, are using it for your business, and have authority to accept these terms for that business ("you").
3. A service in development
Sailvane is in development. Features may be incomplete, may change or may be removed, and early access may end at any time. Until a paid service is offered under separate terms, early access is free and provided as it is.
4. Your account
- Keep your sign-in details secure, and give access only to people who should have it.
- You are responsible for what happens in your account, including actions by people you invite.
- Tell us promptly if you think your account has been accessed without permission.
5. Permitted use
You may use Sailvane to plan, manage and report on advertising for your own business, or for clients who have authorised you. You must not:
- break the law, or advertise anything illegal, misleading or prohibited by the advertising platforms
- connect advertising accounts you are not authorised to manage
- try to access other users' data, or get around Sailvane's security
- copy, resell or reverse engineer Sailvane, or overload it (for example with automated requests)
6. Advertising decisions and spend
Sailvane helps you plan and manage advertising. You decide what runs: nothing is meant to spend money without your approval. You remain responsible for your advertising, including what ads say, where they run, and complying with advertising rules and platform policies.
Advertising costs are charged by the platforms (such as Google and Meta) to your own accounts, not by Sailvane. Sailvane uses AI to suggest plans and wording, and suggestions can be wrong: check them before you approve them. We do not promise any particular advertising results.
7. Third-party integrations
Sailvane can connect to services you choose, such as Google Ads and, in future, Meta. When you connect one:
- you authorise Sailvane to access it as described in our Privacy Policy, and you can disconnect at any time
- your use of that service remains subject to its own terms and policies (for example Google's and Meta's advertising terms)
- we are not responsible for those services, including changes to them, outages, or their decisions about your accounts or ads
8. Your data and content
You keep ownership of your data and of the content you provide. You allow us to use it only to provide Sailvane to you, as described in our Privacy Policy. Ad wording and plans that Sailvane creates for you are yours to use.
9. Intellectual property
Sailvane, including its software, design, name and logo, belongs to us. These terms do not give you any rights in it, other than to use it as these terms allow. If you send us feedback, we may use it to improve Sailvane, without any obligation to you.
10. Availability
We aim to keep Sailvane working, but while it is in development we cannot promise it will always be available, error-free or secure against every threat. We may suspend or change it, for example for maintenance or to fix problems.
11. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Otherwise, while Sailvane is provided free during development: we provide it "as is", without warranties; we are not liable for indirect or consequential loss, or for loss of profit, revenue, data or advertising spend; and our total liability to you is limited to £100.
12. Ending use
You can stop using Sailvane at any time, and ask us to delete your account. We may suspend or end your access if you break these terms or if we stop offering Sailvane. On ending, you can ask for a copy of your data, as described in our Privacy Policy.
13. Changes to these terms
We may update these terms as Sailvane develops. If a change is significant, we will tell users with access before it takes effect. The date at the top shows when the terms last changed.
14. Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute. If you have a concern, please contact us first: we will try to resolve it quickly.
